General Terms & Conditions<\/h1>

The following terms and conditions shall form an integral part of the travel contract entered into between a customer and Brdar d.o.o., Banja Luka, Bosnia and Herzegovina (hereinafter referred to as Brdar), which the customers conclude with Brdar as the tour operator either directly or via an agent. However, any terms and conditions mentioned separately in specific travel offers shall take precedence. Please read these terms and conditions carefully.<\/p>

Brdar\u2019s agents, representatives, and guides act on behalf of Brdar, but are not parties to this contract and are not responsible or liable for any failure to provide any service as may be described in our literature or related to the contract.<\/p>

General Terms and Conditions \u2013 Tours<\/h2>

Booking and Payment<\/h3>

By signing up for the tour through the submission of the online booking form and payment of the tour deposit, the customer makes a binding offer to Brdar d.o.o. to conclude a travel contract. Brdar cannot accept a participant without a signed booking form. The contract will enter into force upon the written travel confirmation from Brdar. A deposit of 500 EUR per person for a guided tour and 500 EUR per person for a self-guided tour is required at the time of booking. This deposit secures a place on the tour. Availability for guided tours is limited, and reservations are made on a first-come, first-served basis.<\/p>

The remaining balance of the tour price must be paid without further notice 60 days before the start of the tour, unless otherwise specified in the tour description. If full payment is not received by the specified due date, Brdar reserves the right to treat the reservation as canceled and charge a cancellation fee as outlined in these terms and conditions.<\/p>

Tour Prices and Price Changes<\/h3>

The tour prices stated on the website and in literature are based on the motorcycle selection and shared accommodation (twin or double room). All participants are required to pay the tour price. Customers participating as riders on Brdar d.o.o.\u2018s motorcycles shall pay the tour price for a rider according to the chosen motorcycle model. Passengers traveling with the riders on Brdar\u2019s motorcycles shall pay the tour price for a passenger. Drivers and passengers joining the tour with their own vehicles are considered participants and shall pay the tour price for a driver with their own vehicle and a passenger, respectively. Any person using services included in the tour without booking through Brdar is considered a participant and must pay the full tour price to Brdar.<\/p>

A customer traveling solo shall pay a single room supplement. If a solo traveler requests to share a twin room with another participant on the tour, Brdar will make efforts to find a suitable roommate. If this is not possible, a single room supplement will be charged.<\/p>

Prices quoted by Brdar, its agents, or publications are those in effect at the time of printing\/publishing. In rare cases, due to factors beyond Brdar\u2019s control, Brdar reserves the right to change the tour prices at any time up to 60 days before the tour commences. Brdar also reserves the right to correct typographical and calculation errors at any time.<\/p>

Loyalty Discount<\/h3>

Each tour you take with Brdar d.o.o. grants you a 50 EUR per person discount on all future Brdar tours (e.g. second tour: 50 EUR discount, third tour: 100 EUR discount, fourth tour: 150 EUR discount, etc.), with a maximum discount of 300 EUR per person. This discount applies to both riders and passengers participating in all guided and self-guided tours with a minimum duration of nine days.<\/p>

Two Tours in One Season Discount<\/h3>

For completing two tours with a minimum duration of nine days in one season, Brdar d.o.o. offers a discount of 100 EUR per person for the second tour.<\/p>

Discounts offered by Brdar cannot be combined with other existing discounts.<\/p>

Motorcycles<\/h3>

Brdar d.o.o. provides motorcycles as part of the tour package. The pictures of the motorcycles in the literature or on this website may not always represent the exact version of the motorcycles provided. For specific or customized information regarding the exact motorcycle versions, please contact us via email or phone.<\/p>

Brdar will make every effort to provide the requested motorcycle model; however, it reserves the right to replace it with a comparable model in cases of uncontrollable situations. These include, but are not limited to, technical defects, damage due to accidents, theft, or similar incidents. Brdar is not responsible or liable for delays caused by the manufacturer\u2019s failure to deliver motorcycles on time. If Brdar is unable to provide a comparable model, a prorated refund for any difference in rental rates, if applicable, will be refunded to the customer. Brdar will make every effort to contact the participant prior to any substitution. Most participants will ride the motorcycle confirmed at the time of booking. Any other liability on the part of Brdar is therefore excluded.<\/p>

The rental period is not interrupted due to damage to the motorcycle or the participant\u2019s inability to ride it. During the rental period, Brdar is not obligated to replace a damaged motorcycle. In the event of a technical defect with the rented motorcycle, the customer agrees to inform the Brdar contact person without delay.<\/p>

Motorcycle Insurance<\/h3>

All motorcycles are insured with\u00a0Third party liability insurance<\/strong>\u00a0and\u00a0Comprehensive vehicle insurance<\/strong>.<\/p>

The\u00a0Third party liability insurance<\/strong>\u00a0comes with a mandatory deductible in the amount of 300 EUR when the renter is deemed at fault.<\/p>

The Comprehensive Vehicle Insurance comes with a deductible, for which Brdar d.o.o. takes a security deposit. A security deposit ranging from 0 EUR to 3,500 EUR, depending on the motorcycle model and the type of insurance, must be secured by a credit card or paid in cash to Brdar at the time of motorcycle handover at the beginning of the rental period. This security deposit will be refunded when the motorcycle is returned undamaged to Brdar.<\/p>

Any damage to the motorcycle up to the insurance excess will be deducted from the security deposit. In the case of loss or theft, the renter is responsible for the amount of the standard security deposit, regardless of the VIP or Super VIP motorcycle insurance. The GPS unit is not included in the motorcycle insurance and must be paid for separately if damaged or lost.<\/p>

AMTours offers three insurance options:<\/strong><\/p>

  1. Standard motorcycle insurance<\/strong>\u00a0is included in the tour price.<\/li>
  2. VIP motorcycle insurance<\/strong>\u00a0is optional. The premium costs 25 EUR per day and lowers the security deposit for the motorcycle.<\/li>
  3. Super VIP motorcycle insurance<\/strong>\u00a0is optional. The premium costs 40 EUR per day and lowers the security deposit for the motorcycle to 0 EUR.<\/li><\/ol>

    VIP motorcycle insurance and Super VIP motorcycle insurance are available for all tours and rentals with a minimum duration of 7 days, and for all riders who hold a full motorcycle driving license for at least two years, and are of a minimum 25 years of age and less than 75 years of age. Riders who hold a full motorcycle driving license for less than 2 years are responsible for the full value of the motorcycle they are renting, the standard security deposit does not apply in this case.<\/p>

    Motorcycle Damage<\/h3>

    The customer is liable for all the damage to the rented motorcycle, documents, parts and accessories, that occur during the rental period. This includes, but is not limited to, theft or loss, damage due to an accident or operational damage, damage as the result of improper use and damage that reduces the value of the motorcycle. The term “damage” is to exclude reasonable wear and tear. Minor blemishes of paint chips from gravel, stones, and insects are considered normal wear and tear. Damage of scratches caused by an accident, dropping a motorcycle or riding a motorcycle through bushes and off road is not considered normal wear and tear.<\/p>

    In case of damage to the rented motorcycle, the customer is liable for repair costs, recovery and return costs, costs for experts, any reduction in technical and market value.<\/p>

    If Brdar d.o.o. has to transport the motorcycle back to its premises due to damage for which the customer is responsible, Brdar reserves the right to invoice the customer for recovering the motorcycle. The minimum charge is 150 EUR, which covers the first 50 kilometers; each additional kilometer will be charged at a rate of 1.50 EUR per kilometer. The distance will be calculated for both directions of the journey.<\/p>

    Own Motorcycle<\/h3>

    A customer who participates in Brdar d.o.o.\u2019s tours with their own vehicle is responsible for ensuring that the vehicle is in compliance with the law and in perfect technical condition. The customer is obliged to reimburse Brdar for any damage caused due to failure to meet these requirements. The customer will also bear any additional costs incurred (e.g., for vehicle recovery, technical repairs, etc.).<\/p>

    Brdar does not offer any vehicle insurance to customers who participate in the tour with their own motorcycle.<\/p>

    Passport, Visa, Driving License and International Driving License<\/h3>

    The customer undertakes to possess valid documents, which are required in order to participate in the tour: a passport, valid at least 6 months after the end of the tour, a visa (where necessary), a national driving license and an international driving license (where necessary).<\/p>

    The customer is responsible for complying with passport and visa regulations of the respective visiting countries and takes full responsibility for consequences resulting from their non-compliance.<\/p>

    By completing the booking, the customer declares that they possess a valid driving license for the duration of the tour and for the vehicle used in the tour. The customer must inform Brdar d.o.o. without delay of any changes regarding their driving license that may affect participation in the tour (e.g., revocation of the driving license, etc.). If it is discovered after the booking and before or during the tour that the customer does not have a valid driving license, Brdar will be released from its obligation to fulfill the contract, and the cancellation fees outlined in these terms and conditions will apply. In such cases, Brdar reserves the right to withhold the motorcycle and exclude the customer from participating in the tour. Brdar is not obligated to reimburse any paid services and will not be liable for any additional costs incurred by the customer due to this situation.<\/p>

    All non-European citizens are required to have an International driving license to drive in European countries.<\/p>

    Minimum Number of Participants<\/h3>

    All guided tours have a guaranteed departure and are accompanied by a guide on a motorcycle.<\/p>

    Brdar d.o.o. also provides a support van for luggage and up to 2 passengers as part of the tour package for guided tours with a minimum of 4 motorcycles or 6 participants.<\/p>

    If there are fewer motorcycles or participants than the minimum required for the guided tour, and the participants do not accept the guided tour without the support van, Brdar will offer a self-guided tour at the current self-guided tour prices. If the participants do not agree to the guided tour without the support van or opt for a self-guided tour, Brdar will refund their deposit and payments in full, which will constitute full settlement.<\/p>

    Brdar is not liable for any additional costs or losses incurred by the customers due to the cancellation of the guided tour for lack of participants. This includes, but is not limited to, the cost of pre-paid airline tickets, hotel reservations, and vehicle rentals.<\/p>

    Change of Participant<\/h3>

    The person of the tour participant may only be changed with Brdar d.o.o.\u2019s agreement and if the substitute person meets all the conditions for participation in the tour. The person transferring and the substitute person shall jointly be responsible for any outstanding payments as well as any additional costs incurred due to the transfer.<\/p>

    Cancellation Charge<\/h3>

    In the case of a customer canceling the booking after confirmation, Brdar d.o.o. reserves the right to charge a cancellation fee based on the time of cancellation.<\/p>

    No exceptions to this policy can be made for any reason. It is strongly recommended to take out trip cancellation insurance. You may consider Brdar d.o.o.\u2019s Trip Cancellation Insurance.<\/a><\/p>

    \u00a0<\/p>

    Brdar d.o.o. is not required to make refunds once the tour has commenced, regardless of the reason for the participant\u2019s inability to complete the tour.<\/p>

    Tour Services<\/h3>

    Brdar d.o.o. is responsible for providing the services listed in the tour descriptions according to local standards. Brdar carefully selects and continuously monitors its contractors, such as hotels and restaurants. In case a service is not provided or is provided defectively, the customer must notify the Brdar representative on-site without delay. If the customer fails to do so, no claims for damages due to a lack of service or a defectively provided service will be accepted.<\/p>

    Situations and events beyond Brdar\u2019s control (force majeure) may arise (e.g., roadworks, hotel closures, natural disasters, bad weather conditions, government orders, strikes, riots, war or war-like conditions, epidemics, etc.) which may make it necessary for Brdar to reschedule or cancel a tour, change itineraries, or make substitutions regarding hotels, cities, guides, and other travel arrangements. Brdar reserves the right to withdraw any part or all of the tour without prior notice or make necessary changes. Any extra costs, if applicable, shall be paid by the customer. Brdar does not assume responsibility or liability for any resulting losses, expenses, or inconvenience to the participant.<\/p>

    Local Provisions<\/h3>

    The customer shall participate in road traffic at the respective tour destination at their own responsibility and undertakes to observe the provisions of the local traffic regulations. If the customer fails to comply with the traffic laws, Brdar d.o.o. reserves the right to revoke the contract and remove the customer\u2019s rented motorcycle.<\/p>

    All traffic tickets, penalties, administrative fines, or similar sanctions, as well as damages to legally protected interests of third parties resulting from non-compliance with local traffic regulations, shall be paid by the customer. A service charge of 30 EUR per ticket will apply for passing the rider\u2019s information to the authorities. In cases where Brdar pays the fine on behalf of the customer, the fine will be reinvoiced to the driver of the motorcycle in question and considered a contractual penalty. A service charge of 55 EUR will apply for reinvoicing.<\/p>

    Off-Road Driving<\/h3>

    Off-road driving with motorcycles provided by AMTours shall not be permitted outside of the itinerary determined by AMTours. It shall neither be permitted to improperly use the rented motorcycle. The customer shall fully bear the damages caused by unauthorized off-road driving and an improper use without an excess.<\/p>

    Own Responsibility and Ability To Drive<\/h3>

    The guide provided by Brdar d.o.o. determines a rough itinerary which the customer shall follow at their own responsibility. The customer is obliged to adjust their driving style to the prevailing circumstances and their own ability to drive. If the customer is unable to follow the itinerary, they must stop and inform the guide without delay.<\/p>

    Different participants take part in Brdar\u2019s tours, and naturally, the driving skills of individual participants may differ. The customer undertakes to show consideration for other participants. If a participant does not have the necessary ability to drive or lacks full control over the motorcycle to drive safely, Brdar shall be released from its obligation to fulfill the contract. In such cases, Brdar reserves the right to remove the motorcycle and exclude the customer from participating in the tour.<\/p>

    Customer’s Conduct and Liability<\/h3>

    Participants agree not to cause any damage to the natural surroundings or third parties through their actions while riding their motorcycles. They agree to observe local traffic laws and follow safe group travel practices as described by the tour leader and the guidelines provided by Brdar d.o.o. In the event a participant repeatedly ignores rules or causes others to feel threatened by their actions, Brdar reserves the right to revoke the contract and remove the participant\u2019s rental motorcycle.<\/p>

    The customer is liable for all personal and material damages they cause due to negligence and agrees to hold Brdar harmless from all claims related to such damages. Damages caused by the customer\u2019s errors, lack of driving ability, or improper driving behavior (e.g., driving with the front wheel off the ground, non-compliance with safety distances, driving on walkways, etc.) or driving under conditions that impair fitness to drive are considered the customer\u2019s responsibility.<\/p>

    The customer is not allowed to consume alcohol, medication, or any other substances that affect their ability to drive during the riding day until the motorcycle is parked for the night. This also applies to customers who participate as passengers. In case of non-compliance, Brdar reserves the right to revoke the contract and remove the participant\u2019s rental motorcycle.<\/p>

    Weather Conditions<\/h3>

    Brdar d.o.o. makes an effort to schedule its tours at times when the weather conditions in the respective tour regions are favorable for motorcycling. However, many tours pass through areas where weather conditions can change abruptly. Brdar d.o.o. is not responsible for bad weather conditions that may occur during the tour. The participant is not entitled to a refund or reimbursement for the tour and\/or rental price in such cases.<\/p>

    Data Protection and Copyright<\/h3>

    The photographs and videos produced by representatives of Brdar d.o.o. during the tour are the property of Brdar d.o.o. under copyright law. Brdar d.o.o. is entitled to use this material for marketing and advertising purposes, including images in which participants can be recognized, without incurring any costs owed to the participant. Participants who submit their photographs to Brdar d.o.o. agree to allow the use of their photographs by Brdar d.o.o. for marketing and advertising purposes.<\/p>

    Miscellaneous<\/h3>

    Brdar d.o.o. recommends taking out adequate travel, health, and accident insurance policies, as well as trip cancellation insurance.<\/p>

    Baggage entrusted to Brdar d.o.o. for transport each day of the tour is done so at the participant\u2019s own risk. Brdar d.o.o. assumes no responsibility for theft, loss, damage, or delay in delivering the baggage to tour participants. Baggage insurance is recommended.<\/p>

    It is recommended that the customer does not bring objects of special value on the tours. It is further recommended to the customer to carefully watch over their personal belongings. Brdar d.o.o. is not responsible for lost or stolen items from its premises, motorcycles and their cases, or support vehicles.<\/p>

    The customer is fully aware of the risks and dangers involved in outdoor activities like swimming, white-water rafting, rock climbing, or any other activity potentially suggested as a supplemental activity on the tour and accepts full responsibility for participating in the activities.<\/p>

    Oral agreements with an agency of Brdar d.o.o., with Brdar d.o.o., or with a tour guide of Brdar d.o.o. shall only be effective if they have been confirmed by Brdar d.o.o. in writing. Tour guides shall not be entitled to undertake activities that diverge from the travel contract concluded with Brdar d.o.o. If individual provisions of these travel terms and conditions are legally invalid, this does not make the remaining provisions invalid.<\/p>

    Applicable Law<\/h3>

    The contractual relationship of the customer with Brdar d.o.o. shall be governed by the law of Bosnia and Herzegovina.<\/p>

    The place of performance shall be the registered office of Brdar d.o.o. in Banja Luka, Bosnia and Herzegovina.<\/p>

    All disputes arising from this agreement will be resolved by the court of law in Banja Luka, Bosnia and Herzegovina.<\/p>

    General Terms and Conditions \u2013 Rentals<\/h2>

    The following terms and conditions of rentals shall form an integral part of the rental agreement entered into between a customer (renter) and Brdar d.o.o., [address in Banja Luka, Bosnia and Herzegovina], also known as [Brand Name], which the customer (renter) concludes with Brdar d.o.o. as the lessor either directly or via an agent.<\/p>

    The Renter<\/h3>

    The renter is the signatory of the rental agreement and the person responsible for the motorcycle, regardless of who booked the motorcycle and\/or who pays the rental fees. The rental motorcycle may only be driven by the renter, that is, the person whose personal data is provided in the rental agreement. The renter undertakes to possess a valid driving license for the duration of the rental period.<\/p>

    The Lessor<\/h3>

    The owner and the lessor of the motorcycle at any time is Brdar doo Banja Luka.<\/p>

    Booking and Payment<\/h3>

    A motorcycle rental reservation becomes final with the submission of the online booking form and payment of a 300 EUR non-refundable deposit. If a customer fails to remit the deposit, Brdar d.o.o. may cancel the reservation at any time. Modification of an existing rental reservation can be made free of charge one time, if made at least 21 days before the commencement of the rental. The rental balance amount shall be paid before or at the time of the motorcycle\u2019s pickup.<\/p>

    All motorcycle rental modifications and cancellations must be received IN WRITING at the office of Brdar d.o.o.<\/p>

    Motorcycle<\/h3>

    The pictures of the motorcycles in the literature or on this website do not always represent the exact version of the motorcycles provided. Please email or call if you need specific or customization information on exact motorcycle versions.<\/p>

    Brdar d.o.o. shall make every effort to provide the renter the requested motorcycle model; however, it reserves the right to replace it with a comparable model in case of uncontrollable situations. These include, but are not limited to, technical defect, damage due to an accident, theft, or a similar incident. Brdar d.o.o. is not responsible or liable for a delay occurring from the manufacturer\u2019s failure to deliver the motorcycles on time. If Brdar d.o.o. is unable to provide a comparable model, a prorated refund for the difference in models\u2019 rental rates, if any, will be refunded to the renter. Brdar d.o.o. will endeavor to contact the renter prior to any substitution.<\/p>

    Minimum Rental Period<\/h3>

    The minimum rental duration is one day on weekdays, from Monday through Friday, and two days on weekends, Saturday and Sunday, with the motorcycle pickup on Friday afternoon and return on Monday morning, provided those days are not national holidays.<\/p>

    Required Documents<\/h3>

    The customer undertakes to possess valid documents, which are required in order to rent a motorcycle: a valid passport, a national driving license, and an international driving license (where necessary). By completing the booking, the customer declares to possess a valid driving license for the duration of the rental and for the motorcycle booked. All non-European citizens are required to have an International driving licence to drive in European countries.<\/p>

    Receiving and Returning the Motorcycle<\/h3>

    The renter takes over the motorcycle in good mechanical condition, with all the necessary equipment and motorcycle documents. The renter is obliged to return the rented motorcycle at the time and place as agreed upon in the rental agreement and in the same state the motorcycle was rented, with the same equipment and documents.<\/p>

    If the motorcycle has been held or reserved for the renter in advance, there will be no refunds for a late pickup or an early return of the motorcycle. The renter shall pay the full rental price for the entire rental period initially planned.<\/p>

    If the renter delays the agreed return time, the first 59 minutes are free of charge. Each hour thereafter is charged at one-fifth (1\/5) of the daily rate, up to five hours, which shall constitute a full day\u2019s charge.<\/p>

    There is a fee in the amount of 48 EUR to be paid for the motorcycle pickups and returns outside of Brdar d.o.o.\u2019s working hours, which are Monday to Friday from 8:00 to 16:00.<\/p>

    The motorcycle is delivered and must be returned with a full fuel tank. Otherwise, the renter will be charged for the fuel and refueling costs according to the valid price list (25 \u20ac + fuel cost). The renter shall pay for all fuel and oil used in the motorcycle during the rental period.<\/p>

    The Renter is Prohibited From<\/h3>
    • Using the motorcycle for commercial transport of passengers or goods.<\/li>
    • Taking part in any race, speed test or contest, or vehicle test.<\/li>
    • Driving on roads of racing circuits and off-road driving.<\/li>
    • Sub-renting or selling the motorcycle or its parts, equipment and accessories to a third person.<\/li>
    • Driving while under the influence of alcohol, drugs or any other substances which impair the ability to drive.<\/li>
    • Overloading the rented motorcycle.<\/li>
    • Making any technical or optical modifications on the motorcycle.<\/li>
    • Using the motorcycle for any illegal purposes (e.g., criminal acts, violation of customs, etc.).<\/li><\/ul>

      The Renter’s Obligations<\/h3>

      The renter shall ensure that:<\/p>

      • The water in the radiator and battery of the motorcycle is maintained at the proper levels.<\/li>
      • The oil in the motorcycle is maintained at the proper level.<\/li>
      • The tires are maintained at their proper pressure.<\/li><\/ul>

        The renter shall ensure that all reasonable care is taken in handling and parking the motorcycle, and that it is securely locked when not in use by locking the handlebar and activating the alarm, if the motorcycle is equipped with one.<\/p>

        The renter shall observe driving and road traffic regulations and is responsible for all traffic tickets received during the rental. A service charge in the amount of 30 EUR per ticket will apply for passing the rider’s information to the authorities. In cases where AMTours would pay the fine on behalf of the customer, the fine will be reinvoiced to the driver of the motorcycle in question, which will be considered a contractual penalty. A service charge of 55 EUR will apply for reinvoicing.<\/p>

        The comprehensive vehicle insurance comes with a deductible for which Brdar d.o.o. takes a security deposit. A security deposit ranging from 0 EUR to 3,500 EUR, depending on the motorcycle model and type of insurance, must be secured by a credit card or paid in cash to Brdar d.o.o. at the time of the motorcycle handover at the start of the rental period. This security deposit will be refunded when the motorcycle is returned undamaged.<\/p>

In case of loss or theft, the renter is responsible for the amount of the standard security deposit, regardless of the VIP or Super VIP motorcycle insurance. The GPS unit is not included in the motorcycle insurance and must be paid in full if damaged or lost.<\/p>

        Brdar d.o.o. offers three insurance options:<\/p>

        1.Standard motorcycle insurance<\/b><\/span> is included in the rental price.<\/p>

        2.VIP motorcycle insurance<\/b><\/span> is optional. The premium is 25 EUR per day and reduces the security deposit for the motorcycle.<\/p>

        3.Super VIP motorcycle insurance<\/b><\/span> is optional. The premium is 40 EUR per day and reduces the security deposit to 0 EUR.<\/p>

        VIP and Super VIP motorcycle insurance are available for all rentals with a minimum duration of 7 days, and for riders who hold a full motorcycle license for at least 2 years, and are aged between 25 and 75 years. Riders with less than 2 years of experience are responsible for the full value of the motorcycle they are renting, and the standard security deposit does not apply in this case.<\/p>

        Regardless of the insurance, the renter is fully liable for:<\/p>

        \u2022Any damage to the motorcycle caused by the renter or any other driver under the influence of alcohol, drugs, or other substances that impair driving ability.<\/p>

        \u2022Any damage caused intentionally or due to gross negligence.<\/p>

        \u2022Any damage if the driver did not hold a valid driver\u2019s license at the time of the damage.<\/p>

        \u2022Any damage if the driver leaves the scene of an accident.<\/p>

        \u2022Any damage caused by operating the motorcycle by an unauthorized driver.<\/p>

        \u2022Lost or damaged GPS unit (if the GPS unit was rented together with the motorcycle).<\/p>

        \u2022Transport of the damaged motorcycle back to the rental location.<\/p>

        \u2022Lost motorcycle documentation, for which the renter shall pay 80 EUR.<\/p>

        Motorcycle Breakdown<\/h4>

        In case of a breakdown, the renter is obliged to notify Brdar d.o.o. without delay and follow their instructions for further actions. Repairs necessary on the route must be performed by authorized professionals only. Any charges incurred will be reimbursed upon presentation of the receipt for the paid replacement parts and repair services.<\/p>

        Accident and Theft<\/h3>

        In case of an accident or theft, the renter is obligated to notify the police and Brdar d.o.o. without delay and follow their instructions. The renter must secure all evidence (e.g., witnesses, track marks, etc.) and record the personal details of those involved.<\/p>

        Motorcycle Damage<\/h3>

        The renter is responsible for all damage to the rented motorcycle, documents, parts, and accessories that occurs during the rental period. This includes, but is not limited to, theft or loss, damage due to an accident, operational damage, improper use, and damage that reduces the value of the motorcycle. The term \u201cdamage\u201d excludes reasonable wear and tear. Minor paint chips from gravel, stones, and insects are considered normal wear and tear. Damage such as scratches caused by accidents, dropping the motorcycle, or riding off-road through bushes is not considered normal wear and tear.<\/p>

        The renter is obligated to notify Brdar d.o.o. without delay of any damage caused to the rented motorcycle and follow Brdar d.o.o.\u2019s instructions for further actions. In the case of damage to the rented motorcycle, the renter is liable for repair costs, recovery and return costs, expert fees, and any reduction in technical or market value.<\/p>

        If Brdar d.o.o. must transport the motorcycle back to its premises due to damage for which the renter is responsible, Brdar d.o.o. reserves the right to invoice the renter for the transportation of the motorcycle. The minimum charge is 150 EUR, with the first 50 kilometers covered; every additional kilometer is charged at 1.50 EUR per kilometer. The distance is calculated for both legs of the journey.<\/p>

        Liability<\/h3>

        The participants in a motorcycle rental are fully aware of the risks and dangers involved and accept full liability. It is agreed and understood that the owners, operators, and agents of this rental, including Brdar d.o.o., are not responsible for the safety of any customer and cannot be held liable for any event related to the operation or the client\u2019s participation in the rental, which may result in injury, death, or any other damage to the client, their property, family, heirs, or assigns.<\/p>

        Brdar d.o.o. is not responsible for the loss or damage of personal belongings left behind on the motorcycle or in its cases during the rental period or after it.<\/p>

        Applicable Law<\/h3>

        The contractual relationship of the customer with Brdar d.o.o. shall be governed by the laws of Bosnia and Herzegovina.<\/p>

        The place of performance shall be the registered office of Brdar d.o.o. in Banja Luka, Bosnia and Herzegovina.<\/p>
