General Terms and Conditions, Tours

The following terms and conditions shall form an integral part of the travel contract entered into between a customer and Brdar d.o.o., Banja Luka, Bosnia and Herzegovina (referred to as Brdar), which the customers conclude with Brdar as the tour operator either directly or via an agent. However, any terms and conditions mentioned separately in specific travel offers shall take precedence. Please read these terms and conditions carefully.

Brdar's agents, representatives, and guides act on behalf of Brdar, but are not parties to this contract and are not responsible or liable for any failure to provide any service as may be described in our literature or related to the contract.

Booking and Payment

By signing up for the tour through the submission of the online booking form and payment of the tour deposit, the customer makes a binding offer to Brdar d.o.o. to conclude a travel contract. Brdar cannot accept a participant without a signed booking form. The contract will enter into force upon the written travel confirmation from Brdar. A deposit of 500 EUR per person for a guided tour and 500 EUR per person for a self-guided tour is required at the time of booking. This deposit secures a place on the tour. Availability for guided tours is limited, and reservations are made on a first-come, first-served basis.

The remaining balance of the tour price must be paid without further notice 60 days before the start of the tour, unless otherwise specified in the tour description. If full payment is not received by the specified due date, Brdar reserves the right to treat the reservation as canceled and charge a cancellation fee as outlined in these terms and conditions.

Tour Prices and Price Changes

The tour prices stated on the website and in literature are based on the motorcycle selection and shared accommodation (twin or double room). All participants are required to pay the tour price. Customers participating as riders on Brdar's motorcycles shall pay the tour price for a rider according to the chosen motorcycle model. Passengers traveling with riders shall pay the tour price for a passenger. Drivers and passengers joining the tour with their own vehicles are considered participants and shall pay the corresponding tour price. Any person using services included in the tour without booking through Brdar is considered a participant and must pay the full tour price to Brdar.

A customer traveling solo shall pay a single room supplement. If a solo traveler requests to share a twin room with another participant on the tour, Brdar will make efforts to find a suitable roommate. If this is not possible, a single room supplement will be charged.

Prices quoted by Brdar, its agents, or publications are those in effect at the time of printing or publishing. In rare cases, due to factors beyond Brdar's control, Brdar reserves the right to change the tour prices at any time up to 60 days before the tour commences. Brdar also reserves the right to correct typographical and calculation errors at any time.

Loyalty Discount and Two Tours in One Season Discount

Each tour you take with Brdar d.o.o. grants you a 50 EUR per person discount on all future Brdar tours (for example, second tour: 50 EUR discount, third tour: 100 EUR discount, fourth tour: 150 EUR discount), with a maximum discount of 300 EUR per person. This discount applies to both riders and passengers participating in all guided and self-guided tours with a minimum duration of nine days.

For completing two tours with a minimum duration of nine days in one season, Brdar d.o.o. offers a discount of 100 EUR per person for the second tour. Discounts offered by Brdar cannot be combined with other existing discounts.

Motorcycles

Brdar d.o.o. provides motorcycles as part of the tour package. The pictures of the motorcycles in the literature or on this website may not always represent the exact version of the motorcycles provided. For specific or customized information regarding the exact motorcycle versions, please contact us via email or phone.

Brdar will make every effort to provide the requested motorcycle model; however, it reserves the right to replace it with a comparable model in cases of uncontrollable situations. These include, but are not limited to, technical defects, damage due to accidents, theft, or similar incidents. Brdar is not responsible or liable for delays caused by the manufacturer's failure to deliver motorcycles on time. If Brdar is unable to provide a comparable model, a prorated refund for any difference in rental rates, if applicable, will be refunded to the customer. Brdar will make every effort to contact the participant prior to any substitution.

The rental period is not interrupted due to damage to the motorcycle or the participant's inability to ride it. During the rental period, Brdar is not obligated to replace a damaged motorcycle. In the event of a technical defect with the rented motorcycle, the customer agrees to inform the Brdar contact person without delay.

Motorcycle Insurance

All motorcycles are insured with Third party liability insurance and Comprehensive vehicle insurance. The Third party liability insurance comes with a mandatory deductible of 300 EUR when the renter is deemed at fault.

The Comprehensive vehicle insurance comes with a deductible, for which Brdar d.o.o. takes a security deposit. A security deposit ranging from 0 EUR to 3,500 EUR, depending on the motorcycle model and the type of insurance, must be secured by a credit card or paid in cash to Brdar at the time of motorcycle handover at the beginning of the rental period. This security deposit will be refunded when the motorcycle is returned undamaged.

Any damage to the motorcycle up to the insurance excess will be deducted from the security deposit. In the case of loss or theft, the renter is responsible for the amount of the standard security deposit, regardless of the VIP or Super VIP motorcycle insurance. The GPS unit is not included in the motorcycle insurance and must be paid for separately if damaged or lost.

Brdar d.o.o. offers three insurance options:

  1. Standard motorcycle insurance is included in the tour price.
  2. VIP motorcycle insurance is optional. The premium costs 25 EUR per day and lowers the security deposit for the motorcycle.
  3. Super VIP motorcycle insurance is optional. The premium costs 40 EUR per day and lowers the security deposit to 0 EUR.

VIP and Super VIP motorcycle insurance are available for all tours and rentals with a minimum duration of 7 days, and for all riders who hold a full motorcycle driving license for at least two years, and are between 25 and 75 years of age. Riders who hold a full motorcycle license for less than 2 years are responsible for the full value of the motorcycle they are renting, and the standard security deposit does not apply in this case. Motorcycle Damage

The customer is liable for all damage to the rented motorcycle, documents, parts and accessories that occurs during the rental period. This includes, but is not limited to, theft or loss, damage due to an accident or operational damage, damage as a result of improper use, and damage that reduces the value of the motorcycle. The term damage excludes reasonable wear and tear. Minor blemishes or paint chips from gravel, stones, and insects are considered normal wear and tear. Scratches caused by an accident, dropping a motorcycle, or riding through bushes and off road are not considered normal wear and tear.

In case of damage, the customer is liable for repair costs, recovery and return costs, costs for experts, and any reduction in technical and market value. If Brdar d.o.o. has to transport the motorcycle back to its premises due to damage for which the customer is responsible, Brdar reserves the right to invoice the customer for recovering the motorcycle. The minimum charge is 150 EUR, which covers the first 50 kilometers; each additional kilometer is charged at 1.50 EUR per kilometer. The distance is calculated for both directions of the journey.

Passport, Visa, Driving License and Own Motorcycle

The customer undertakes to possess valid documents required to participate in the tour: a passport valid at least 6 months after the end of the tour, a visa where necessary, a national driving license, and an international driving license where necessary. The customer is responsible for complying with passport and visa regulations of the visiting countries and takes full responsibility for consequences resulting from non-compliance. All non-European citizens are required to have an international driving license to drive in European countries.

A customer who participates with their own vehicle is responsible for ensuring that the vehicle complies with the law and is in perfect technical condition, and is obliged to reimburse Brdar for any damage caused due to failure to meet these requirements. Brdar does not offer any vehicle insurance to customers who participate in the tour with their own motorcycle.

Minimum Number of Participants

All guided tours have a guaranteed departure and are accompanied by a guide on a motorcycle. Brdar d.o.o. also provides a support van for luggage and up to 2 passengers as part of the tour package for guided tours with a minimum of 4 motorcycles or 6 participants.

If there are fewer motorcycles or participants than the minimum required, and the participants do not accept the guided tour without the support van, Brdar will offer a self-guided tour at the current self-guided tour prices. If the participants do not agree to either option, Brdar will refund their deposit and payments in full, which constitutes full settlement. Brdar is not liable for any additional costs or losses incurred by the customers due to the cancellation of the guided tour for lack of participants, including pre-paid airline tickets, hotel reservations, and vehicle rentals.

Change of Participant and Cancellation Charge

The person of the tour participant may only be changed with Brdar d.o.o.'s agreement and if the substitute meets all conditions for participation. The transferring person and the substitute shall jointly be responsible for any outstanding payments and additional costs incurred due to the transfer.

In the case of a customer canceling the booking after confirmation, Brdar d.o.o. reserves the right to charge a cancellation fee based on the time of cancellation.

No exceptions to this policy can be made for any reason. It is strongly recommended to take out trip cancellation insurance. You may consider Brdar d.o.o.'s Trip Cancellation Insurance. Brdar d.o.o. is not required to make refunds once the tour has commenced, regardless of the reason for the participant's inability to complete the tour.

Tour Services

Brdar d.o.o. is responsible for providing the services listed in the tour descriptions according to local standards. Brdar carefully selects and continuously monitors its contractors, such as hotels and restaurants. If a service is not provided or is provided defectively, the customer must notify the Brdar representative on-site without delay. If the customer fails to do so, no claims for damages will be accepted.

Situations beyond Brdar's control (force majeure) may arise, such as roadworks, hotel closures, natural disasters, bad weather, government orders, strikes, riots, war or war-like conditions, and epidemics, which may make it necessary for Brdar to reschedule or cancel a tour, change itineraries, or make substitutions regarding hotels, cities, guides, and other arrangements. Brdar reserves the right to withdraw any part or all of the tour without prior notice or make necessary changes. Any extra costs, if applicable, shall be paid by the customer. Brdar does not assume responsibility for any resulting losses, expenses, or inconvenience.

Local Provisions, Conduct and Liability

The customer shall participate in road traffic at the respective tour destination at their own responsibility and undertakes to observe local traffic regulations. All traffic tickets, penalties, administrative fines, or similar sanctions resulting from non-compliance shall be paid by the customer. A service charge of 30 EUR per ticket applies for passing the rider's information to the authorities. Where Brdar pays the fine on behalf of the customer, the fine will be reinvoiced to the driver as a contractual penalty, with a service charge of 55 EUR for reinvoicing.

Off-road driving with motorcycles provided by Brdar is not permitted outside of the determined itinerary, nor is improper use of the rented motorcycle. The customer shall fully bear the damages caused by unauthorized off-road driving and improper use without an excess.

The guide determines a rough itinerary which the customer follows at their own responsibility. The customer is obliged to adjust their driving style to the prevailing circumstances and their own ability to drive. If a participant does not have the necessary ability or lacks full control over the motorcycle to drive safely, Brdar shall be released from its obligation to fulfill the contract and reserves the right to remove the motorcycle and exclude the customer from the tour.

Participants agree not to cause any damage to the natural surroundings or third parties, to observe local traffic laws, and to follow safe group travel practices. The customer is liable for all personal and material damages they cause due to negligence and agrees to hold Brdar harmless from all related claims. The customer is not allowed to consume alcohol, medication, or any other substances that affect their ability to drive during the riding day until the motorcycle is parked for the night. This also applies to passengers.

Brdar d.o.o. makes an effort to schedule tours when weather conditions are favorable for motorcycling, but is not responsible for bad weather that may occur during the tour, and the participant is not entitled to a refund in such cases. The photographs and videos produced by representatives of Brdar d.o.o. during the tour are the property of Brdar d.o.o. under copyright law, and Brdar is entitled to use this material for marketing and advertising purposes.

Brdar d.o.o. recommends taking out adequate travel, health, and accident insurance, as well as trip cancellation insurance. Baggage entrusted to Brdar for transport each day is done so at the participant's own risk. It is recommended that the customer does not bring objects of special value and carefully watches over personal belongings. The customer is fully aware of the risks involved in outdoor activities such as swimming, white-water rafting, or rock climbing, and accepts full responsibility for participating.

Applicable Law (Tours)

The contractual relationship of the customer with Brdar d.o.o. shall be governed by the law of Bosnia and Herzegovina. The place of performance shall be the registered office of Brdar d.o.o. in Banja Luka. All disputes arising from this agreement will be resolved by the court of law in Banja Luka, Bosnia and Herzegovina.

General Terms and Conditions, Rentals

The following terms and conditions of rentals shall form an integral part of the rental agreement entered into between a customer (renter) and Brdar d.o.o., Banja Luka, Bosnia and Herzegovina, which the customer concludes with Brdar d.o.o. as the lessor either directly or via an agent.

The Renter and The Lessor

The renter is the signatory of the rental agreement and the person responsible for the motorcycle, regardless of who booked it or who pays the rental fees. The rental motorcycle may only be driven by the renter, that is, the person whose personal data is provided in the rental agreement. The renter undertakes to possess a valid driving license for the duration of the rental period. The owner and lessor of the motorcycle at any time is Brdar d.o.o. Banja Luka.

Booking, Payment and Minimum Period

A motorcycle rental reservation becomes final with the submission of the online booking form and payment of a 300 EUR non-refundable deposit. If a customer fails to remit the deposit, Brdar d.o.o. may cancel the reservation at any time. Modification of an existing rental reservation can be made free of charge one time, if made at least 21 days before the commencement of the rental. The rental balance shall be paid before or at the time of pickup. All rental modifications and cancellations must be received in writing at the office of Brdar d.o.o.

The minimum rental duration is one day on weekdays, from Monday through Friday, and two days on weekends, with pickup on Friday afternoon and return on Monday morning, provided those days are not national holidays. The customer undertakes to possess a valid passport, national driving license, and an international driving license where necessary. All non-European citizens are required to have an international driving license to drive in European countries.

Receiving and Returning the Motorcycle

The renter takes over the motorcycle in good mechanical condition, with all necessary equipment and documents, and is obliged to return it at the agreed time and place in the same state, with the same equipment and documents. If the motorcycle has been reserved in advance, there are no refunds for a late pickup or an early return; the renter pays the full rental price for the entire period initially planned.

If the renter delays the agreed return time, the first 59 minutes are free of charge. Each hour thereafter is charged at one-fifth of the daily rate, up to five hours, which constitutes a full day's charge. There is a fee of 48 EUR for pickups and returns outside of Brdar's working hours, which are Monday to Friday from 8:00 to 16:00. The motorcycle is delivered and must be returned with a full fuel tank. Otherwise, the renter is charged for fuel and refueling costs according to the valid price list (25 EUR plus fuel cost).

The Renter is Prohibited From

  • Using the motorcycle for commercial transport of passengers or goods.
  • Taking part in any race, speed test, contest, or vehicle test.
  • Driving on racing circuit roads and off-road driving.
  • Sub-renting or selling the motorcycle or its parts, equipment and accessories to a third person.
  • Driving while under the influence of alcohol, drugs, or any other substances which impair the ability to drive.
  • Overloading the rented motorcycle.
  • Making any technical or optical modifications to the motorcycle.
  • Using the motorcycle for any illegal purposes.

The Renter's Obligations

The renter shall ensure that the water in the radiator and battery is at the proper levels, that the oil is at the proper level, and that the tires are at their proper pressure. The renter shall take all reasonable care in handling and parking the motorcycle, and ensure it is securely locked when not in use by locking the handlebar and activating the alarm, if equipped. The renter shall observe driving and road traffic regulations and is responsible for all traffic tickets received during the rental. A service charge of 30 EUR per ticket applies for passing the rider's information to the authorities, and a service charge of 55 EUR applies for reinvoicing where Brdar pays a fine on the customer's behalf.

Insurance, Breakdown, Accident and Damage

All motorcycles are insured with Third party liability insurance and Comprehensive vehicle insurance. The Third party liability insurance comes with a mandatory deductible of 300 EUR when the renter is deemed at fault. The Comprehensive vehicle insurance comes with a deductible for which Brdar d.o.o. takes a security deposit ranging from 0 EUR to 3,500 EUR, depending on the motorcycle model and type of insurance. Standard insurance is included in the rental price; VIP insurance (25 EUR per day) and Super VIP insurance (40 EUR per day) are optional and reduce the security deposit, with Super VIP reducing it to 0 EUR. VIP and Super VIP insurance are available for rentals of at least 7 days, for riders holding a full motorcycle license for at least 2 years and aged between 25 and 75 years.

Regardless of the insurance, the renter is fully liable for any damage caused while under the influence of alcohol, drugs, or other impairing substances; any damage caused intentionally or through gross negligence; any damage if the driver did not hold a valid license at the time; any damage if the driver leaves the scene of an accident; any damage caused by an unauthorized driver; a lost or damaged GPS unit; transport of the damaged motorcycle back to the rental location; and lost motorcycle documentation, for which the renter shall pay 80 EUR.

In case of a breakdown, the renter must notify Brdar d.o.o. without delay and follow their instructions; repairs on the route must be performed by authorized professionals only, and charges are reimbursed upon presentation of receipts. In case of an accident or theft, the renter must notify the police and Brdar d.o.o. without delay, secure all evidence, and record the details of those involved. The renter is responsible for all damage to the rented motorcycle, documents, parts, and accessories during the rental period, excluding reasonable wear and tear, and must notify Brdar without delay. The transport charge for damage is a minimum of 150 EUR covering the first 50 kilometers, with 1.50 EUR per additional kilometer, calculated for both legs of the journey.

Liability

Participants in a motorcycle rental are fully aware of the risks and dangers involved and accept full liability. It is agreed and understood that the owners, operators, and agents of this rental, including Brdar d.o.o., are not responsible for the safety of any customer and cannot be held liable for any event related to the operation or the client's participation in the rental, which may result in injury, death, or any other damage to the client, their property, family, heirs, or assigns. Brdar d.o.o. is not responsible for the loss or damage of personal belongings left behind on the motorcycle or in its cases during or after the rental period.

Applicable Law (Rentals)

The contractual relationship of the customer with Brdar d.o.o. shall be governed by the laws of Bosnia and Herzegovina. The place of performance shall be the registered office of Brdar d.o.o. in Banja Luka. All disputes arising from this agreement will be resolved by the court of law in Banja Luka, Bosnia and Herzegovina.
