General Terms and Conditions, Tours

The following terms and conditions shall form an integral part of the travel contract entered into between a customer and Brdar d.o.o., Banja Luka, Bosnia and Herzegovina (referred to as Brdar), which the customers conclude with Brdar as the tour operator either directly or via an agent. However, any terms and conditions mentioned separately in specific travel offers shall take precedence. Please read these terms and conditions carefully.

Brdar's agents, representatives, and guides act on behalf of Brdar, but are not parties to this contract and are not responsible or liable for any failure to provide any service as may be described in our literature or related to the contract.

Booking and Payment

To request a place on a tour, the participant must complete and submit the Participant Registration & Motorcycle Selection form. Submission of the form constitutes a booking request and does not, by itself, confirm a reservation.

Booking Confirmation

Following receipt of the completed registration form, Brdar Moto Tours & Rentals will review the participant's details, requested services and availability. An individual offer or travel contract, together with the applicable payment instructions, will then be provided.

A reservation will be confirmed only after the required initial payment has been received by Brdar Moto Tours & Rentals and written booking confirmation has been issued by Brdar.

Payment Terms

The total tour price, required initial payment, payment schedule and applicable deadlines will be specified in the individual offer or travel contract.

The participant must ensure that payments are received by the deadlines stated in the applicable contractual documents. Failure to pay by the specified deadline may result in cancellation of the booking, subject to the applicable contractual terms and cancellation provisions.

Payment Methods

Payments must be made using the payment method and account details specified in the payment instructions issued by Brdar Moto Tours & Rentals. The participant is responsible for any bank charges imposed by their payment provider, where applicable.

Booking Documentation

The applicable General Terms & Conditions will be provided to the participant before the travel contract is concluded. Participants renting a motorcycle from Brdar Moto Tours & Rentals will also receive the applicable Motorcycle Rental Terms & Conditions before entering into the motorcycle rental agreement.

The individual travel contract, applicable terms and conditions, payment documentation and written booking confirmation will form part of the booking records.

Tour Prices and Price Changes

Tour prices published on the website and in promotional materials are based on the selected motorcycle model and shared accommodation (twin or double room). All participants are required to pay the applicable tour price. Riders renting motorcycles from Brdar Moto Tours & Rentals shall pay the price applicable to their selected motorcycle model. Passengers travelling with a rider shall pay the applicable passenger price. Participants joining the tour with their own motorcycles shall pay the tour price specified for that arrangement. Any person using services included in the tour without booking through Brdar Moto Tours & Rentals must pay the applicable tour price.

Loyalty Discount and Two Tours in One Season Discount

Each tour you take with Brdar d.o.o. grants you a 50 EUR per person discount on all future Brdar tours (for example, second tour: 50 EUR discount, third tour: 100 EUR discount, fourth tour: 150 EUR discount), with a maximum discount of 300 EUR per person. This discount applies to both riders and passengers participating in all guided and self-guided tours with a minimum duration of nine days.

For completing two tours with a minimum duration of nine days in one season, Brdar d.o.o. offers a discount of 100 EUR per person for the second tour. Discounts offered by Brdar cannot be combined with other existing discounts.

Motorcycles

Brdar Moto Tours & Rentals provides motorcycles as part of selected tour packages and motorcycle rental services. Motorcycle photographs and descriptions published on the website or in promotional materials are for illustrative purposes and may not represent the exact motorcycle supplied. The motorcycle model and relevant specifications will be confirmed in the individual offer or rental agreement.

Brdar Moto Tours & Rentals will make reasonable efforts to provide the requested motorcycle model. However, if circumstances beyond its reasonable control prevent this, including mechanical failure, technical defects or other unforeseen circumstances, Brdar may offer a comparable replacement motorcycle, subject to availability.

If a comparable replacement motorcycle cannot be provided, Brdar Moto Tours & Rentals will inform the customer and agree on an appropriate solution, which may include a refund of the applicable price difference or another mutually agreed arrangement, as appropriate to the circumstances and subject to applicable law.

If a motorcycle develops a technical fault during the rental period, the renter must notify Brdar Moto Tours & Rentals without undue delay and follow the instructions provided. Any assistance, replacement motorcycle or refund will be assessed according to the circumstances, the applicable rental agreement and these Terms & Conditions.

Motorcycle Insurance and Ride Safe Protection

Motorcycles provided by Brdar Moto Tours & Rentals, including motorcycles supplied by partners, are covered by applicable third-party liability and comprehensive vehicle insurance policies. The scope of insurance coverage, deductibles, exclusions and conditions may vary depending on the motorcycle and the applicable insurance policy.

For motorcycles rented from Brdar Moto Tours & Rentals, customers may choose from the following Ride Safe protection options, subject to the applicable rental conditions:

Ride Safe is included in the standard motorcycle rental price. The applicable security deposit depends on the motorcycle model.

Ride Safe Plus is an optional protection package charged at EUR 25 per rental day. It reduces the required security deposit in accordance with the applicable deposit schedule.

Ride Safe Premium is an optional protection package charged at EUR 40 per rental day. Under the applicable deposit schedule, the security deposit is reduced to EUR 0.

The applicable package fee and security deposit depend on the motorcycle model and the selected protection option. The selected option, applicable fees and deposit requirements will be confirmed before the rental agreement is finalised.

Ride Safe protection options do not replace the applicable insurance policy and do not automatically eliminate the renter's liability for damage, theft, loss or circumstances excluded from the applicable insurance coverage or protection terms. The renter's rights and obligations, including applicable exclusions and liability limits, are specified in the Motorcycle Rental Terms & Conditions and the rental agreement.

For motorcycles supplied by partners, available protection options, fees, security deposits and applicable conditions may differ. These details will be confirmed with the customer before the rental agreement is finalised.

The security deposit, where applicable, is handled in accordance with the rental agreement. Any deductions and the release of the remaining deposit are subject to the applicable rental terms.

Motorcycle Damage

The renter is responsible for damage to the rented motorcycle, its documents, parts and accessories occurring during the rental period, subject to the applicable insurance coverage, the selected Ride Safe protection option and the Motorcycle Rental Terms & Conditions. Normal wear and tear is excluded. Minor blemishes and paint chips resulting from normal use may be considered normal wear and tear, while damage caused by an accident, dropping the motorcycle, improper use or riding through bushes or off-road areas is not considered normal wear and tear.

In the event of damage, the renter's financial responsibility, if any, shall be determined in accordance with the applicable insurance policy, the selected Ride Safe protection option and the Motorcycle Rental Terms & Conditions. Depending on the circumstances, additional costs may include reasonable recovery and transportation expenses, repair costs not covered by insurance, and other documented costs for which the renter is contractually responsible. Any applicable limits, exclusions, deductibles and security deposit deductions shall be governed by the rental agreement and applicable terms. The renter will be informed of any claim or deduction and its basis.

Passport, Visa, Driving License and Own Motorcycle

The customer undertakes to possess valid documents required to participate in the tour: a passport valid at least 6 months after the end of the tour, a visa where necessary, a national driving license, and an international driving license where necessary. The customer is responsible for complying with passport and visa regulations of the visiting countries and takes full responsibility for consequences resulting from non-compliance. All non-European citizens are required to have an international driving license to drive in European countries.

A customer who participates with their own vehicle is responsible for ensuring that the vehicle complies with the law and is in perfect technical condition, and is obliged to reimburse Brdar for any damage caused due to failure to meet these requirements. Brdar does not offer any vehicle insurance to customers who participate in the tour with their own motorcycle.

Minimum Number of Participants

All guided tours have a guaranteed departure and are accompanied by a guide on a motorcycle. Brdar d.o.o. also provides a support van for luggage and up to 2 passengers as part of the tour package for guided tours with a minimum of 4 motorcycles or 6 participants.

If there are fewer motorcycles or participants than the minimum required, and the participants do not accept the guided tour without the support van, Brdar will offer a self-guided tour at the current self-guided tour prices. If the participants do not agree to either option, Brdar will refund their deposit and payments in full, which constitutes full settlement. Brdar is not liable for any additional costs or losses incurred by the customers due to the cancellation of the guided tour for lack of participants, including pre-paid airline tickets, hotel reservations, and vehicle rentals.

Change of Participant and Cancellation Charge

The person of the tour participant may only be changed with Brdar d.o.o.'s agreement and if the substitute meets all conditions for participation. The transferring person and the substitute shall jointly be responsible for any outstanding payments and additional costs incurred due to the transfer.

In the case of a customer canceling the booking after confirmation, Brdar d.o.o. reserves the right to charge a cancellation fee based on the time of cancellation.

More than 60 days50% of tour deposit
30 to 60 days50% of tour price

Cancellation charges will be applied in accordance with the applicable cancellation policy and mandatory legal requirements. Any refund or other entitlement will be determined in accordance with the applicable terms and conditions and relevant law. Customers are strongly advised to consider purchasing trip cancellation insurance, subject to the insurer's policy terms, conditions and exclusions.

Tour Services

Brdar d.o.o. is responsible for providing the services included in the confirmed tour arrangements, in accordance with the applicable contract and mandatory legal requirements. Brdar carefully selects its service providers and makes reasonable efforts to monitor the quality of the services they provide. If a service included in the tour is not provided or is provided incorrectly, the customer should notify the tour representative or Brdar d.o.o. without undue delay, where reasonably possible, so that the matter can be addressed promptly. Any complaint, remedy or claim shall be handled in accordance with the applicable contract and mandatory legal requirements.

Situations beyond Brdar's reasonable control (force majeure) may arise, including road closures, natural disasters, severe weather, government orders, strikes, riots, war or war-like conditions, epidemics or other events that make it unsafe, unlawful or impracticable to operate a tour as planned. In such circumstances, Brdar d.o.o. may need to modify the itinerary, change accommodation or other arrangements, postpone the tour or cancel it where reasonably necessary. Brdar will inform affected customers as soon as reasonably practicable and will make reasonable efforts to offer a suitable alternative where possible. Any additional costs, refunds or other remedies will be determined in accordance with the applicable contract and mandatory legal requirements. Nothing in this section excludes or limits any rights that customers may have under applicable law.

Local Provisions, Conduct and Liability

The customer is responsible for complying with applicable traffic laws and regulations in each country visited during the tour. Traffic fines, penalties and administrative charges arising from the customer's conduct or failure to comply with these requirements shall be the customer's responsibility. If Brdar d.o.o. receives a fine or official notice relating to the customer's use of a motorcycle or participation in the tour, Brdar may provide the relevant customer information to the competent authorities where legally required or permitted. Where Brdar d.o.o. pays a fine or incurs an administrative cost on behalf of the customer, the customer shall reimburse the amount actually paid, together with a reasonable administrative handling fee of EUR 30 per ticket, where permitted by applicable law. Any charge shall be supported by appropriate documentation.

Off-road riding with motorcycles provided by Brdar d.o.o. is not permitted unless expressly authorised in writing by Brdar d.o.o. or specifically included in the agreed tour itinerary. Customers must use the motorcycle responsibly and in accordance with the manufacturer's instructions, applicable traffic laws and the Motorcycle Rental Terms & Conditions. The customer may be held financially responsible for damage resulting from unauthorised off-road riding, improper use, negligence or a breach of the applicable rental conditions, subject to the relevant insurance coverage, selected Ride Safe protection option and applicable law.

The guide determines a rough itinerary which the customer follows at their own responsibility. The customer is obliged to adjust their driving style to the prevailing circumstances and their own ability to drive. If a participant does not have the necessary ability or lacks full control over the motorcycle to drive safely, Brdar shall be released from its obligation to fulfill the contract and reserves the right to remove the motorcycle and exclude the customer from the tour.

Participants agree not to cause any damage to the natural surroundings or third parties, to observe local traffic laws, and to follow safe group travel practices. The customer is liable for all personal and material damages they cause due to negligence and agrees to hold Brdar harmless from all related claims. The customer is not allowed to consume alcohol, medication, or any other substances that affect their ability to drive during the riding day until the motorcycle is parked for the night. This also applies to passengers.

Brdar d.o.o. makes reasonable efforts to schedule tours during periods generally suitable for motorcycling. However, weather conditions may change during a tour and may require adjustments to the itinerary or riding schedule for safety reasons. Participants are expected to follow the guide's safety instructions and bring suitable riding equipment. Any changes to the tour or requests for refunds arising from weather conditions shall be handled in accordance with the applicable booking terms and mandatory legal requirements.

Photographs and videos created by representatives of Brdar d.o.o. during a tour may be used for marketing and promotional purposes, subject to applicable data protection, privacy and image rights requirements. Where consent is legally required, it will be obtained separately. Participants who do not wish to appear in promotional materials should inform Brdar d.o.o. before or during the tour so that reasonable efforts can be made to accommodate their request.

Participants are strongly advised to obtain appropriate travel, health and accident insurance, including trip cancellation and emergency medical or repatriation coverage where appropriate. Unless expressly stated in the individual offer, such insurance is not included in the tour price. Where Brdar d.o.o. assists with arranging insurance, it acts only in the capacity disclosed to the customer, and the insurance contract remains subject to the insurer's terms, conditions and exclusions.

Participants are responsible for their personal belongings and should avoid bringing items of significant value unless necessary. Where baggage is transported by Brdar d.o.o. or its representative, participants must ensure that it is suitably packed and secured. Any liability relating to baggage shall be determined in accordance with the applicable contract and mandatory legal requirements.

Motorcycling tours and optional outdoor activities may involve inherent risks, including swimming, white-water rafting, rock climbing and other recreational activities. Participants must assess their own abilities, follow safety instructions and comply with the requirements of the relevant activity provider. Participation in optional activities is subject to the applicable safety rules, conditions and legal requirements.

Applicable Law (Tours)

The contractual relationship of the customer with Brdar d.o.o. shall be governed by the law of Bosnia and Herzegovina. The place of performance shall be the registered office of Brdar d.o.o. in Banja Luka. All disputes arising from this agreement will be resolved by the court of law in Banja Luka, Bosnia and Herzegovina.

General Terms and Conditions, Rentals

The following terms and conditions of rentals shall form an integral part of the rental agreement entered into between a customer (renter) and Brdar d.o.o., Banja Luka, Bosnia and Herzegovina, which the customer concludes with Brdar d.o.o. as the lessor either directly or via an agent.

The Renter and The Lessor

The renter is the person who enters into and signs the motorcycle rental agreement and is responsible for complying with its terms, regardless of who made the booking or paid the rental fees. Unless expressly agreed otherwise in writing, only the renter named in the rental agreement is authorised to ride the motorcycle. The renter must hold a valid motorcycle driving licence appropriate for the rented motorcycle and must meet all applicable legal and rental requirements throughout the rental period.

Motorcycles may be owned by Brdar d.o.o. or supplied by a third-party partner. The applicable rental agreement will identify the contracting lessor and, where relevant, the motorcycle owner. The renter will be informed of the applicable rental conditions before the agreement is finalised.

Booking, Payment and Minimum Period

A motorcycle rental reservation is subject to availability and becomes confirmed only after Brdar d.o.o. has accepted the booking and provided written confirmation. Any advance payment required to secure the reservation, including its amount, payment deadline and applicable cancellation conditions, will be specified in the offer or booking confirmation. The advance payment for the reservation is separate from the security deposit required for the motorcycle, where applicable.

The remaining rental balance must be paid by the deadline specified in the booking confirmation and, unless otherwise agreed in writing, before the motorcycle is handed over. Any amendments or cancellations must be submitted in writing and are subject to the applicable booking conditions and mandatory legal requirements. If a required payment is not received by the specified deadline, Brdar d.o.o. may cancel the reservation after notifying the customer, subject to the applicable contract and law.

The minimum rental duration is one day on weekdays, from Monday through Friday, and two days on weekends, with pickup on Friday afternoon and return on Monday morning, provided those days are not national holidays. The customer undertakes to possess a valid passport, national driving license, and an international driving license where necessary. All non-European citizens are required to have an international driving license to drive in European countries.

Receiving and Returning the Motorcycle

The renter must inspect the motorcycle, its equipment and accompanying documents at handover and report any visible damage, defects or missing items before departure. The condition of the motorcycle and any existing damage should be recorded in a handover report, supported by photographs where appropriate. By accepting the motorcycle, the renter acknowledges its recorded condition but does not waive any rights relating to hidden defects or issues that could not reasonably have been identified during the inspection.

The renter must return the motorcycle at the agreed time and location, together with all supplied equipment, accessories and documents, in the condition required by the rental agreement, subject to normal wear and tear. Late pickup or early return does not automatically entitle the renter to a refund or reduction of the rental price. Any exception must be agreed in writing or arise under applicable law.

If the renter returns the motorcycle later than the agreed return time without prior approval, a grace period of 59 minutes applies. After the grace period, additional charges will be calculated according to the applicable rental rate and the delay, as specified in the rental agreement or booking confirmation. Where the delay prevents the motorcycle from being rented to another customer, additional documented losses may be claimed only where permitted by the rental agreement and applicable law, without double charging for the same loss.

Pick-up or return outside Brdar d.o.o.'s regular working hours, Monday to Friday from 09:00 to 17:00, must be agreed in advance and may incur an additional service fee of EUR 48. The motorcycle is supplied with a full fuel tank and must be returned with a full tank. If it is returned with less fuel, the renter will be charged for the missing fuel and any applicable refuelling service fee, as per price list provided before the rental is confirmed.

The Renter is Prohibited From

  • Using the motorcycle for commercial transport of passengers or goods.
  • Taking part in any race, speed test, contest, or vehicle test.
  • Driving on racing circuit roads and off-road driving.
  • Sub-renting or selling the motorcycle or its parts, equipment and accessories to a third person.
  • Driving while under the influence of alcohol, drugs, or any other substances which impair the ability to drive.
  • Overloading the rented motorcycle.
  • Making any technical or optical modifications to the motorcycle.
  • Using the motorcycle for any illegal purposes.

The Renter's Obligations

The renter must operate the motorcycle responsibly and take reasonable care of it throughout the rental period. Before each ride, the renter should carry out appropriate basic safety checks, including checking the tyres, lights, visible fluid leaks and any warning indicators, and must not ride the motorcycle if it appears unsafe or develops a fault that could affect safe operation. The renter must follow the manufacturer's instructions and must not perform maintenance, repairs or technical modifications without prior authorisation from Brdar d.o.o., except for reasonable emergency measures necessary to prevent immediate further damage or danger.

The renter must park the motorcycle safely, secure it when unattended and use any security devices supplied with it. The renter is responsible for traffic fines and penalties arising from their conduct during the rental period. Where Brdar d.o.o. is required or legally permitted to identify the renter to the competent authorities, the renter must provide accurate information and reasonable cooperation. Any administrative handling fee charged by Brdar d.o.o. must be disclosed in these Rental Terms & Conditions and must not duplicate a fee charged for the same administrative service.

The renter must promptly notify Brdar d.o.o. of any accident, damage, theft, warning light, mechanical fault or other incident affecting the motorcycle and follow the instructions provided. The renter must not arrange repairs or admit liability on behalf of Brdar d.o.o. without authorisation, except where immediate action is necessary for safety or required by law.

Insurance, Breakdown, Accident and Damage

Motorcycles supplied for rental by Brdar Moto Tours & Rentals, including motorcycles provided by partners, are covered by third-party liability and comprehensive vehicle insurance, subject to the terms, conditions, exclusions and deductibles of the applicable insurance policies.

For motorcycles rented directly from Brdar Moto Tours & Rentals, the renter may select one of the following Ride Safe protection options, subject to availability and the applicable motorcycle model:

  • Ride Safe: Included in the standard rental price. The applicable security deposit depends on the motorcycle model.
  • Ride Safe Plus: An optional protection package charged at EUR 25 per rental day. It reduces the required security deposit in accordance with the applicable deposit schedule.
  • Ride Safe Premium: An optional protection package charged at EUR 40 per rental day. Under the applicable deposit schedule, the security deposit is reduced to EUR 0.

The available protection options, applicable daily fees and required security deposit will be confirmed to the renter before the rental is finalised. For motorcycles supplied by partners, the available options, fees, deposits and conditions may differ and will be communicated before the rental is confirmed.

Ride Safe protection options do not replace the applicable insurance policy and do not automatically eliminate the renter's financial responsibility for damage, theft, loss, deductibles or circumstances excluded from the applicable insurance coverage. The scope of any protection and the renter's remaining liability are subject to the applicable insurance policy and the relevant provisions of these Motorcycle Rental Terms & Conditions.

The selected Ride Safe protection option does not apply to damage, loss or costs arising from circumstances expressly excluded under these Rental Terms & Conditions or the applicable insurance policy. Such circumstances may include, where supported by the applicable policy and law, riding under the influence of alcohol or drugs, intentional damage, gross negligence, riding without the required valid licence, allowing an unauthorised person to ride the motorcycle, or leaving the scene of an accident in breach of legal obligations.

The renter must promptly report any accident, damage, theft or loss to Brdar d.o.o. and, where required by law or the circumstances, to the police. The renter must cooperate with the investigation and provide accurate information and relevant evidence. Any financial responsibility of the renter shall be determined according to the applicable insurance coverage, the selected Ride Safe protection option, the circumstances of the incident and these Rental Terms & Conditions.

The renter must not operate or attempt to operate the motorcycle while under the influence of alcohol, illegal drugs, or any medication or other substance that impairs or may impair their ability to ride safely. The renter must not permit any other person who is under the influence of such substances to operate the motorcycle. Brdar d.o.o. may prohibit the renter from continuing to ride if there are reasonable grounds to believe that the renter is impaired or presents a safety risk. A serious breach of this prohibition may result in termination of the rental and recovery of the motorcycle, subject to applicable law. Damage, loss and costs arising from such a breach may be excluded from Ride Safe protection, to the extent permitted by the applicable insurance policy and these Rental Terms & Conditions.

In case of a mechanical breakdown or warning that may affect safe operation, the renter must stop riding when it is unsafe to continue, notify Brdar d.o.o. without undue delay and follow the instructions provided. Repairs must not be arranged without prior authorisation, except for emergency measures necessary to prevent immediate danger or further damage. Any reimbursement of authorised repair expenses requires supporting receipts and confirmation that the work was approved.

In case of an accident, theft or other incident involving the motorcycle, the renter must notify Brdar d.o.o. promptly and contact the police or emergency services where required by law or the circumstances. The renter must cooperate with the authorities, exchange the legally required information, preserve relevant evidence and provide an accurate account of the incident. The renter must not leave the scene of an accident where the law requires them to remain.

The renter is responsible for damage to or loss of the rented motorcycle, its documents, parts and supplied accessories during the rental period, subject to the applicable insurance coverage, the selected Ride Safe protection option, normal wear and tear, and these Rental Terms & Conditions. The renter's financial responsibility will be assessed according to the circumstances of the incident, applicable exclusions and deductibles, and the relevant insurance policy.

Where the motorcycle cannot be safely ridden due to damage or a breakdown, recovery and transportation arrangements must be coordinated with Brdar d.o.o. unless immediate action is necessary for safety or required by law. Where the renter is contractually responsible for the incident and the applicable insurance or assistance coverage does not cover the recovery cost, the transport charge shall be EUR 150 for the first 50 kilometres and EUR 1.50 for each additional kilometre, calculated for the outward and return journey. No recovery charge shall be imposed to the extent that the same cost has already been covered by insurance or another responsible party.

The renter must promptly report the loss of or damage to supplied accessories, including GPS devices, and lost motorcycle documents. Any replacement or administrative fee must be based on the applicable fee schedule disclosed to the renter before the rental is confirmed.

Liability

Participants in a motorcycle rental are fully aware of the risks and dangers involved and accept full liability. It is agreed and understood that the owners, operators, and agents of this rental, including Brdar d.o.o., are not responsible for the safety of any customer and cannot be held liable for any event related to the operation or the client's participation in the rental, which may result in injury, death, or any other damage to the client, their property, family, heirs, or assigns. Brdar d.o.o. is not responsible for the loss or damage of personal belongings left behind on the motorcycle or in its cases during or after the rental period.

Applicable Law (Rentals)

The contractual relationship of the customer with Brdar d.o.o. shall be governed by the laws of Bosnia and Herzegovina. The place of performance shall be the registered office of Brdar d.o.o. in Banja Luka. All disputes arising from this agreement will be resolved by the court of law in Banja Luka, Bosnia and Herzegovina.
